The service provided by Spanity is subject to the following Terms of Use. By accessing to and using the service provided by Spanity, the User agrees to declare he/she is of adult age and to be legally bound by all the terms and conditions hereof. Spanity reserves the right to update the Terms of Use at any time without notice to the User.

Article 1 - Service

Spanity provides information about Spas and Wellness locations in different countries worldwide. The information presented on the website is provided and updated by the Spas and Wellness operators or suppliers contracted with Spanity (hereafter referred to as “Spanity Partners”). While we will make every effort to ensure that such information is accurate, we cannot guarantee the accuracy or completeness of such information nor can we warrant that access to our website will be uninterrupted or fault free.

Spanity also allows User of the website:

  • To buy gift certificates that can be redeemed in spas or wellness locations identified as Spanity Partners. The terms of use for the Gift Certificates are detailed in Article 4.
  • To book online an offer or a treatment proposed by Spanity Partners. The terms of use for the Online Booking are detailed in Article 5.
  • To post review to share his/her experience at a specific spa or wellness location. By submitting a review, the User acknowledges and commits to respect the terms & conditions of review as defined in article 6. Spanity’s moderator will check and ensure that each review respects those terms & conditions before being published on the website.

Spanity only acts as an intermediary between the Users of its website and the Spanity Partners, and therefore do not have, and never intend to have, any contractual involvement in the reservation or the service provided by the Spanity Partners.

Article 2 - Ownership / Intellectual Property

All content and technology available on or underlying the site, including, but not limited to: text, graphics, images, logos, videos and audio, icons, banners, software, etc., and other content are owned by Spanity SAS and protected worldwide under French and foreign copyright, trademark, and other proprietary laws.

The compilation (meaning the collection, arrangement and assembly) of all Web Site Contents is also protected under French and foreign copyright, trademark and other proprietary laws. Unauthorized use of the Web Site Contents is strictly prohibited. Without the written permission of Spanity, you may not reproduce, transmit, publish, distribute, display, modify, create derivative works from, sell or participate in any sale, or exploit in any way, in whole or in part, any of the Web Site Contents or the site.

Article 3 - License

Spanity grants the User a limited, revocable, and non-exclusive license to access and make personal use of the site. However, the User may not frame or utilize framing techniques to enclose the site or any portion thereof without Spanity's prior written consent.

The limited license does not include the right to: (i) modify or download the site or its contents (except caching); (ii) make any use of the site or its Content other than personal use; (iii) create any derivative work based upon either the site or its Content; (iv) collect account information for the benefit of another party; (v) use any meta tags or any other "hidden text" utilizing our name or the Trademarks without our express written consent; or (vi) use software robots, spiders, crawlers, or similar data gathering and extraction tools, or take any other action that may impose an unreasonable burden or load on our infrastructure.

The User shall never in any circumstances, reproduce, copy, distribute, modify, display or distribute for its own account or from third parties all or part of the contents of the website which are the exclusive property of Spanity. The User shall be solely and fully responsible for any damage caused to the website by any means whatsoever, whether in connection with the use or because of acts contrary to applicable laws and regulations (which includes among others damages caused by the following actions: reproduce, copy, display or distribute to the Public any content or part of the website, use data mining robots or software or any similar systems allowing to collect data, reverse-engineer, decompile or disassemble web pages or programs of Spanity…). The User shall, in general, comply with all regulations and indemnify Spanity for all harmful consequences resulting directly or indirectly from the use of the Website. The Partner acknowledges and agrees with all limitations and constraints of the Internet and as such, recognizes the impossibility to ensure the total security of data exchange. Spanity will not be liable for any damage resulting from the transmission of any information, including its Username and/or password via the Service.

Spanity shall never be liable, within the limits of applicable law, for any damages and / or losses, direct or indirect, tangible or intangible, of any nature whatsoever, resulting from the unavailability of the website or any use of the website. The term "use" should be understood in a broad sense i.e. any use of the website whatsoever, lawful or not. Subject to opposite provisions of laws or public order, Spanity shall not be responsible for the malfunctioning of the website, its services, any eventual viruses or other harmful mechanisms and systems. Spanity shall not be responsible for any costs related to possible replacements of equipment, reinstatement measures, restoration of data or other events related to the use by the partner of the website or its contents. The website and its contents are provided without any warranty of any kind. Subject to opposite provisions of laws or public order, Spanity, its suppliers or any third parties mentioned on any Spanity’s website shall not be responsible for any damages whatsoever (including without limitation incidental, consequential damages, loss of opportunity, loss of profit or data, or business interruption) resulting from the use or inability to use all or part of the website and its contents, whatever grounds the claim is based on (warranty, contract, complaint, unauthorized use or other legal reason) and whether Spanity is advised or not of such damages.

Article 4 - Gift Certificates

Article 4.1 - Value Gift Certificates

Use of Spanity value gift certificates constitutes acceptance of the following terms and conditions:

Value Gift certificates are for a single use only.

Upon appropriate validity control, it may be redeemed for services or goods at any Spanity Partner accepting Spanity Gift Certificates. Spanity Partners accepting gift certificates are identified by a specific coloured icon on spanity.com. Face value and corresponding currency are defined on the face of the certificate. If the price of the service or good is superior to the certificate value, the beneficiary of the certificate shall pay the difference directly to the Spanity Partner. If the price of the service or good is less than the certificate value, any unused balance can be converted to credit available only for services or goods provided by the same Spanity Partner. The decision to convert the difference in credit can only be taken by the Spanity Partner.  Spanity shall not guarantee that such credit will be accepted and proposed by the Spanity Partner.

The beneficiary of a Value Gift Certificate must check the availability of the service or good required by contacting the Spanity Partner before coming to its premises. Neither Spanity nor any Spanity Partner will be responsible for service or good booked or provided by spa or supplier not contracted with Spanity to accept Spanity Gift Certificates.

Value Gift Certificates can be transferred but cannot be resold or duplicated. Any unauthorized resale or duplication will invalidate the certificate. Value Gift certificate cannot be redeemed for cash, except in accordance with applicable law. Spanity Value Gift Certificate is non refundable. Neither Spanity nor any Spanity Partner is responsible for loss, theft or mutilation of a Value Gift Certificate.

Value Gift Certificate must be printed and presented to the Spanity Partner for validity check before any service or good may be delivered or provided. Upon confirmation of the validity, the gift certificate must be surrendered to the Spanity Partner. Alternatively, Value Gift Certificates can also be sent by email to the spa prior to the appointment.

Value Gift Certificates can also be redeemed on Spanity.com to pay any order online. If the price of the order is superior to the certificate value, the User shall pay the difference online. If the price of the order is less than the certificate value, any unused balance will be converted into a new Value Gift Certificate sent automatically by email to the User and also available to be downloaded on the User’s account at Spanity.com.

Value Gift Certificate validity is limited by an expiration date mentioned on the face of the certificate. After the expiration date, the gift certificate can be neither exchanged nor used anymore.

Neither Spanity nor any Partner makes any warranty of any kind regarding any service you may receive in connection with your use and redemption of Spanity Gift Certificate.

Neither Spanity nor any partner assumes any responsibility and shall not be liable for any injury, loss, claim, cost, damage, or any special, exemplary, punitive, indirect, incidental, or consequential damages of any kind, whether based in contract, tort, strict liability, or otherwise which arises out of or is in any way connected with (i) your use and redemption of Spanity Gift Certificate or (ii) the performance or non-performance by any third-party providers even if you have been advised of the possibility of damages. Under no circumstance shall Spanity or any Partner be liable for any delay or failure of performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control.

Article 4.2 - Treatment or service Gift Certificates

Use of Spanity treatment or service gift certificates constitutes acceptance of the following terms and conditions:

Service Gift Certificate is for a single use only. Upon appropriate validity control by the Spanity Partner, it may be redeemed for the corresponding service or good defined on the certificate.

The beneficiary of a Service Gift Certificate must check the availability of the good or book the service by booking its appointment online on Spanity.com or by contacting the Spanity Partner before coming to its premises. Neither Spanity nor any Spanity Partner will be responsible for service or good booked or provided by spa or supplier not contracted with Spanity to accept Spanity Gift Certificates.

Service Gift Certificate can be transferred but cannot be resold or duplicated. Any unauthorized resale or duplication will invalidate this certificate. Service Gift certificate cannot be redeemed for cash, except in accordance with applicable law. Service Gift Certificate is non refundable. Neither Spanity nor any Spanity Partner is responsible for loss, theft or mutilation of a Service Gift Certificate.

Service Gift Certificate validity is limited by an expiration date mentioned on the face of the certificate. It can be exchanged up to 30 days after the expiration date under the condition no duplicate has been made and used. Service Gift certificate can be exchanged with:

  • Another gift certificate corresponding to another service or good proposed by the same or another Spanity Partner on www.spanity.com under the condition that it has the same price as the initial treatment, service or good purchased,
  • A value gift certificate with a face value corresponding to the same price as the initial service or good purchased.

Service Gift Certificates can also be redeemed on Spanity.com to pay any order online. If the price of the order is superior to the certificate value, the User shall pay the difference online. If the price of the order is less than the certificate value, any unused balance will be converted into a new Value Gift Certificate sent automatically by email to the User and also available to be downloaded on the User’s account at Spanity.com.

30 days after the expiration date, the gift certificate can neither be exchanged nor be used anymore.

Neither Spanity nor any Partner makes any warranty of any kind regarding any service you may receive in connection with your use and redemption of Spanity Gift Certificate.

Article 5 - Online Reservation

By booking an offer or a treatment through Spanity.com, the User enters into a direct (legally binding) contractual relationship with the Spanity Partners and agrees to accept any terms, conditions, rules and restrictions associated with the corresponding offer or treatment imposed by the Spa Partner. With the exception of the payment obligations mentioned hereunder, Spanity does not have, and never intend to have any contractual involvement in the reservation made by the User. As such, Spanity disclaims all liability arising from or related to the direct contractual relationship between the User and the Spa Partner. Spanity.com act solely as an intermediary between the User and the Spanity Partners, transmitting the details of your reservation to the corresponding Spanity Partner, and sending you a confirmation email for and on behalf of the Spanity Partner. The Spanity Partners are solely responsible for providing and updating all the information available on Spanity.com related to their treatments or offers description, including all rates, availability, modification or cancellation policies. As such, the Spanity Partners are solely responsible for making any available treatment or offer reserved through Spanity.com and to honor this reservation.

By booking a treatment or an offer on Spanity.com, the User agrees to accept any terms, conditions, rules and restrictions associated with such treatment or offer imposed by the Spa Partners. In accordance with the treatment or offer conditions imposed by the Spanity Partner, the User can be required:

  • To pay online through Spanity.com to confirm his/her booking,
  • To provide his/her credit card details as a payment guarantee to confirm the booking and to pay the offer or treatment reserved through Spanity directly at the corresponding Spa Partner’s premises,
  • Or to pay the offer or treatment reserved through Spanity directly at the corresponding Spa Partner’s premises, without providing any payment guarantee.

The confirmation email and attached booking voucher serve as proof of valid reservation and will contain relevant information about the reservation details, offer and payment conditions.

In the event that the Spa Partner cannot honor a confirmed reservation, the Spanity Partner shall propose The User with an alternative appointment date and / or time. In the event that no alternative appointment date and / or time shall suit the User and that the corresponding offer conditions had required the User to pre-pay on Spanity.com to confirm his/her booking, Spanity.com shall reimburse the amount paid to the User within a commercially reasonable time.

The User can modify or cancel his/her reservation on Spanity.com or by contacting directly the Spanity Partner. In accordance with the treatment or offer conditions imposed by the Spanity Partner, the User can be charged for the modification or cancellation of the reservation, or if the User or the beneficiary of the reservation fail to arrive on the requested date or time. If such a charge must be applied, and in accordance with the treatment or offer conditions imposed by the Spanity Partner, this charge can be:

  • Deducted from the amount paid by the User and the difference, if any, shall be reimbursed to the User,
  • Or charged directly to the Credit Card number provided as payment guarantee by the User.

Article 6 - Review

By submitting a review, the User certify that this review is based on his/her personal, direct experience, that he/she has no personal or business relationship with the spa or wellness location reviewed and that he/she has not been offered any incentive or payment from this spa or wellness location to write this review. Reviews must not violate any local or international laws nor any third-party right, including, but not limited to, right of privacy, right of publicity, copyright, trademark, or any other intellectual property or proprietary rights. Reviews must be relevant and relate directly to the spa being reviewed. Content that is not relevant and/or related to the spa being reviewed will be deleted. Reviews may not be commercial in nature and may not contain personal information or messages, including but not limited to email addresses, URLs, phone numbers and postal addresses.

By submitting review, comments or the like contained in any submissions to this Website, the User grants Spanity and its affiliates a non-exclusive, royalty-free, perpetual, transferable, irrevocable and fully sub licensable right to (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Submissions throughout the world in any media, now known or hereafter devised; and (b) use the name that the User submits in connection with such Submission. The User acknowledges that Spanity may choose to provide attribution of your comments or reviews upon our full discretion. The User acknowledges and agrees that Submissions are non-confidential and non-proprietary.

Spanity takes no responsibility and assumes no liability for any Content posted, stored or uploaded by the User or any third party, or for any loss or damage thereto, nor is Spanity liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity the User may encounter.

Article 7 - Account

The User is responsible for maintaining the confidentiality of his/her account information, password and login information. The User agrees to accept responsibility for all activities that occur under his/her account or password. The User acknowledges that he/she is of sufficient legal age to use this site and to create binding legal obligations for any liability the User may incur as a result of the use of this site. The User understands that he/she is financially responsible for all uses of this site he/she may do by using his/her login information.

Article 8 - Privacy

Spanity is committed to the protection of your privacy. We will treat all of the information you provide through our website, including your registration, subscription to our newsletter, RSS service and information you may provide under the contact us webpage strictly confidential. We work to ensure that we have taken all appropriate administrative and technical measures to prevent the unauthorized or unlawful use of your personally identifiable information, and to prevent any accidental loss or destruction of, or damage to, such information. We will not sell or disclose personally identifiable information about you to unaffiliated third parties except in accordance with this "Privacy” section.

In compliance with French Law N° 78-87 of 6th January 1978 updated (referred as “Informatique et Libertés”) and International e-commerce standards, the personal data collected subjected to automatic processing are only accessed by Spanity or any third party authorized personnel in order to allow access or use of the Website. In accordance with current regulations, you may at any time exercise your right to access, rectify, cancel or oppose your personal data. Article 8.1 - Collection of Information

Our website collects certain information about visitors, even when they are not logged in. We may record your IP address, the times and dates of such visits, information about the computer hardware and software you use and other information that may be available. We may also place "cookies" on your computer to recognize you on return visits to enable us to enhance your browsing experience, as well as to collect additional information about you. You may adjust your browser settings or use other means to prevent cookies from being placed on your computer, but doing so may result in reduced functionality and a less personalized browsing experience.

We may ask you to provide certain additional information about yourself, including your name, contact information, the organization you come from and certain other information that we may use to identify yourself. If you choose not to provide such information, you may not be permitted to access certain features, content or services of our website.

Article 8.2 - Use of information

Spanity uses the information that it collects about the User to improve the latter’s browsing experience and also to help us in selecting content and services that the User may find interesting and useful. Information about the content the User visits and services he/she uses may be used alone or in conjunction with information collected from other Users to help us tailoring our website. We may disclose information about the User to carefully selected service providers that we may engage to host the website or to provide other services such as search engine optimization.

Information that the User provides may also be used as part of our efforts to keep the User informed about events, and selected products and services that may be of the User’s interest. In some cases, we may contact the User with information from carefully selected third parties, but we will not provide information to third parties for such purposes. In other cases, your information might be shared with a third party pursuant to a process that contemplates such sharing but which the User knowingly initiates. User’s information may also be shared with spas or wellness locations with which he/she has redeemed Spanity Gift Certificates or booked an appointment through Spanity.com.

We reserve the right to disclose any information that we obtain through the website to appropriate governmental or regulatory authorities, if required by law or any governmental agency.

Except as provided herein, we will not provide the User’s information to third parties for any other purpose, including marketing.

Article 8.3 - Sending of Information

Any information sent to us by Internet e-mail or through the website is not secured and is done so on a non-confidential basis. Any information you send us over the Internet, either through our website or via email is done at your own risk.

Article 9 - Security

Payment is made through the service and platform provided by Paypal. Paypal uses SS.L. protocol to encrypt and protect your credit card information. However, any losses incurred while transmitting the information shall be borne solely and exclusively by the User. If the User is using a public computer to access our services, we recommend signing out once the User has finished using the application.

Article 10 - Limitation of liability

Spanity only acts as the intermediary between the Users of our website and the Spanity spa Partners, and therefore do not have, and never intend to have, any contractual involvement in the reservation or the service provided by the Spanity Partner. As Spanity acts as an intermediary, it shall not be liable in case of damages suffered by the customer and caused by the Partner or suffered by the Partner and caused by the customer arising.

The photographs and information presented on the website are for information purpose only. Although every efforts are made to ensure that the photographs, graphic images and text used to illustrate the displayed spas or wellness locations provided are as accurate as possible on the services and accommodation proposed, variations may occur. Customers may not make any claim in this respect.

Article 11 - Applicable law

These terms and conditions are governed by French law, which is applicable to both substantive and procedural rules.
